1. The seller and how to reach it

2. Scope, consumers and businesses
These terms apply to distance contracts of sale made in the seller's online shop. A consumer is a natural person acting outside their trade, business or profession. Of the rights a consumer has, the mandatory commercial guarantee under Hungarian law also covers a micro, small or medium sized business buying outside its economic activity; the right of withdrawal and the consumer dispute bodies are for consumers only.
By sending an order you confirm that you have read and accept these terms and that you have read the privacy notice. The version in force at the moment you order governs your purchase; its version number appears on the order acknowledgement, and earlier versions stay available on this page.
3. Language of the contract, filing, code of conduct
The language of the contract is Hungarian. The shop also shows courtesy translations of these terms; where they differ, the Hungarian text prevails. The contract is not a written contract in the legal sense. The seller records (files) the order together with the version of these terms it was placed under, and the details stay accessible in the acknowledgement email, on the order status page and, with an account, in the account.
The seller has not signed up to a code of conduct.
4. How an order is placed and how input errors are corrected
- You put the item in your basket. In the basket you can change the quantity or remove the item; the basket is kept for 30 days.
- At the checkout you enter your delivery and billing details and choose the delivery and payment method. At every step you can go back to the previous one, and until the order is sent any detail can be corrected.
- Before you send the order you see a summary of the items, the total payable (with delivery and any cash on delivery fee), the delivery and payment method, and the version of these terms in force.
- You send the order with the button marked "Order with an obligation to pay". Pressing it creates an obligation to pay.
With express payment (Apple Pay, Google Pay) the payment sheet shows the payment provider's own button, so before it opens the shop states in a separate sentence that approving the payment places an order with an obligation to pay, and the delivery address, the delivery method and the total are shown in the sheet.
The shop's products can also be ordered through an artificial intelligence assistant (an intermediary agent) where its provider has an agreement with us. These terms apply then too: before the purchase the seller states the total price, the delivery and payment conditions, the right of withdrawal and where these terms are, through the assistant, and the acknowledgement goes directly to your email address.
5. The acknowledgement and when the contract is made
After you send the order our system sends an automatic acknowledgement to your email address, within 48 hours at the latest. The contract comes into being when that acknowledgement reaches you. If none arrives within 48 hours, you are released from your offer.
The acknowledgement is a durable medium: it carries the order details, the total payable, the seller's details, the version number of these terms, and as PDF attachments the version of these terms itself and the withdrawal notice with the model withdrawal form. You can follow the order on the link in the acknowledgement without signing in.
6. Prices, delivery charge, cash on delivery fee
Prices are shown in the currency of the market you shop in and include VAT at the rate that applies there; they do not include delivery. The delivery charge and the cash on delivery fee are shown before the checkout on the Delivery and payment help page, in the delivery block of the product page and in the basket, and at the checkout line by line before you send the order.
Where a price is reduced, the prior price shown beside it is the lowest price applied in the 30 days before the reduction, and the reduction is always calculated against that reference price.
In the case of an obvious pricing error (for instance a price grossly out of line with the market because of a system fault) the seller may decline the order before acknowledging it; you are told at once, together with the correct price, and anything already paid is refunded.
7. Ways to pay and payment security
- Online payment in the secure payment fields of the payment provider Stripe, embedded in the checkout: card, and Apple Pay and Google Pay where the checkout offers them on your device. The seller never sees or stores your card details; the card issuer may confirm the payment with 3D Secure authentication.
- Cash on delivery: payment to the courier or at the parcel point, in cash or by card as the carrier allows, up to the ceiling shown at the checkout; above the confirmation threshold shown there we ask for a telephone or SMS confirmation before dispatch. The handling fee is shown as its own line at the checkout.
- Gift card: the balance of a gift card bought in this shop can be used at the checkout in part or in full; any remainder is paid with one of the methods above.
Cash on delivery is the cash route Hungarian law requires the seller to offer. The data needed to complete a payment is passed to the payment provider; the privacy notice has the detail.
8. Invoicing
The invoice is issued electronically and sent by email as a PDF; it can also be downloaded from the order status page and from the account. You agree to electronic invoicing when you send the order. A paper invoice is posted free of charge on request. A change to the billing details can be requested from customer service until the invoice is issued.
9. Delivery, collection, passing of risk
Orders are delivered by courier to your door or to a parcel point or locker (GLS, MPL, FoxPost, Packeta). The expected delivery time is shown on the product page, in the basket and at the checkout. The delivery deadline is at most 30 days from the day the contract is made; if the goods cannot be delivered within it you are told, and you choose between a new date and a refund of what you paid.
Risk passes to you when you, or a third party you named, take physical possession of the goods. Please check the packaging on delivery; if it is damaged ask the courier to record it and tell us. Not having such a record does not affect your conformity rights.
10. Right of withdrawal and voluntary return
As a consumer you may withdraw from the contract within 14 days of receiving the goods, without giving a reason. The online withdrawal function is available through the "Withdraw from contract" link in the footer, without signing in; the declaration is sent with the "Confirm withdrawal" button on that form. The conditions, the model form and the refund rules are in the withdrawal notice.
Beyond the statutory right we voluntarily accept returns: you can send an item back within 30 days in total from delivery (the first 14 of them are your statutory right, the remaining days our voluntary allowance). The voluntary return requires the item to be unopened or only tried out, and complete; the price of the item is refunded, the delivery charge is not. The voluntary allowance neither affects nor limits your statutory right.
11. Conformity rights, producer liability, commercial guarantee
Where the goods are not as agreed you have conformity rights against the seller for 2 years from delivery, and a claim against the producer or distributor for a defect in the product itself; electrical appliances sold in the Hungarian market also carry the mandatory guarantee of Hungarian law. The conditions, the periods, the certificate rules and how to claim are set out in the guarantees notice.
If you choose repair as your conformity remedy, the conformity period is extended by 12 months after the repair; the claim form tells you so before you choose repair. Goods sent in for repair or replacement are taken back at the seller's cost.
12. Complaints, supervisory bodies, arbitration board
You can complain in person, by telephone, in writing, by email or by post. Receipt of a written complaint is acknowledged at once at the email address you gave; the complaint is answered on the merits in writing within 30 days, and the complaint with the answer is kept for 3 years. Where we reject a complaint we give reasons in writing and name the authority or dispute resolution body you can take it to, with its contact details.
Consumer protection authority: in Hungary the first instance is the county or Budapest government office competent for the consumer's residence; for the seller's seat that is Zala Vármegyei Kormányhivatal Közlekedési, Műszaki Engedélyezési és Fogyasztóvédelmi Főosztály, Fogyasztóvédelmi Osztály, for the Budapest office Budapest Főváros Kormányhivatala Fogyasztóvédelmi Főosztály; the national authority is the Nemzeti Kereskedelmi és Fogyasztóvédelmi Hatóság (nkfh.gov.hu). If you live in another member state, the consumer protection authority of your own country is competent for you, and an ECC-Net office there can help you reach us.
The alternative dispute resolution body competent for the seller's seat: Győr-Moson-Sopron Vármegyei Kereskedelmi és Iparkamara által működtetett Békéltető Testület, address and postal address: 9022 Győr, Szent István út 10/A, telephone: +36 96 520 217, email: [email protected], website: https://bekeltetesgyor.hu. You may also turn to the body competent where you live, and to a certified alternative dispute resolution entity in your own member state. The seller is obliged to cooperate in the procedure. The seller has not made a general declaration of submission. The board's decision binds the seller even without one where the consumer's claim does not exceed the amount set in the Hungarian consumer protection act, stated in the Hungarian text.
13. Promotions, coupons, gift items, loyalty programme, gift cards
The conditions of a promotion (period, products covered, minimum basket, stock) are stated where the promotion is shown, before you buy. One coupon code can be redeemed per order; the checkout shows how a coupon and loyalty points combine, and the combined reductions can never exceed the cap the checkout applies. A gift item (gift with purchase, buy one get one, cheapest item free) is given only while its condition is met, and appears on the order at zero value.
If you send back an item from a promotional order so that the promotion's condition is no longer met, the refund is calculated at the price that applies to the basket after the return, that is, the proportionate share of the reduction is deducted; the refund notice shows the calculation. A gift item is returned together with the item it came with. The loyalty programme and the gift cards have their own terms.
14. User content: reviews and questions
Product pages show customer reviews and questions. Whoever submits one is responsible for it being true, based on their own experience, free of harm to third parties and free of personal data. We do not publish unlawful, abusive or obscene content, content unrelated to the product or plainly untrue claims; the writer is told the reason by email. Anyone can report unlawful content at [email protected]; we examine the report and tell both the reporter and the writer what we decided. 15. Taking back electrical waste
When a new electrical appliance is delivered to your door we take back a used appliance of the same kind, one for one and free of charge, if you ask for it at the checkout. The electrical waste notice has the detail.
16. Data protection
The privacy notice explains how personal data is handled and the cookie notice explains cookies. Consent to the newsletter, to the review invitation email and to the collection of an old appliance is given at the checkout in separate boxes that are never ticked in advance.
17. Intellectual property
The content of the shop, the product photographs, the videos and the texts are protected by copyright and may be used only with the prior written permission of the rights holder. Fashion by Berlinger Haus is a trade mark of its owner.
18. Changes to these terms and earlier versions
The seller may amend these terms. An amendment applies from the stated effective date and does not affect contracts already made: those are governed by the version in force when the order was placed, whose identifier appears on the acknowledgement and whose text can be opened on this page by version number at any later time.
19. Governing law and disputes
The contract is governed by Hungarian law, without depriving a consumer of the protection of the mandatory rules of the country where they are habitually resident. Matters these terms do not settle are governed by the Hungarian Civil Code, the Hungarian consumer contract and consumer protection legislation and the Hungarian e-commerce act. A consumer may turn to the arbitration body named in section 12 and to the courts.

When is the contract made?
When the email acknowledgement sent after your order reaches you. If nothing arrives within 48 hours, you are released from your offer.
Does the price include VAT?
Yes. Every price shown includes VAT at the rate that applies in the market you shop in. Delivery and the cash on delivery fee are separate lines at the checkout, and the Delivery and payment page shows them before you get there.
How long do I have to send an item back?
30 days in total from delivery: the first 14 days are your statutory right of withdrawal (no reason needed, delivery refunded), the remaining days are our voluntary allowance for an unopened or only tried out, complete item, without the delivery charge.
